Supernatural Enlightenment Course

 

  1. Policies and procedures
  2. I agree to follow all policies and procedures as set down by The Spirit Healer website.
  3. I agree that I will pay the full sum to receive a full copy of sections part one and section part two which is the full video suite for the supernatural enlightenment course. 
  4. All content contained within this online supernatural enlightenment course remains the sole ownership and rights of Miguel enterprises pty ltd and associated Director.
  5. No online content can be copied, transferred or used for any third parties financial gain without the express written authority of the owners of the spirit healer website.
  6. Any person or persons found to be duplicating this online content for their own personal gains are liable to legal prosecution based on Australian contract Laws.
  7. I understand that my personal data provided when enrolling and paying for this course shall remain totally and highly confidential and shall not be disseminated or provided to any third parties.
  8. Indemnity

The client or company who purchases this supernatural enlightenment online course  indemnifies Miguel Enterprises pty ltd and its directors or associates  and keeps the Company indemnified against any loss, cost, expense or damage suffered or incurred by the Client arising directly or indirectly from or related to the provision of the Services, including (but not limited to):

  • any breach or non-observance by the Client of any provision of this Agreement or warranty given under this Agreement;
  • any breach of any law or statute by the client and
  • any right or claim by any third party
  • Any right to sue or take legal action against the directors of Miguel enterprises pty ltd
  • Any content included in this course that is not followed or adhered to directly.

 

  1. Obligations

The Client and any Representative acknowledge and agree that:

in the course of providing the online Services, the Client will:

  1. have access to and knowledge of the Company’s Products and Services, skills and techniques;
  2. May be privy to Confidential Information concerning the Company, its participants, employees, suppliers, and its methods of doing business;
  • the duration, extent and application of the restrictions contained in this Agreement are no greater than is reasonably necessary to protect the Company’s legitimate business interests, including the preservation of its relationships with its participants, suppliers, employees, agents, directors, officers, partners, contractors, advisors and consultants, the goodwill of its business, its Confidential Information and intellectual property; and
  1. the level of benefits, including the Client Fee provided under this Agreement constitutes adequate consideration for the restraint obligations imposed under this Agreement.
  2. The fees paid for this course are non-refundable as all information and knowledge is provided in good faith with the sole purpose of enlightenment and connection of chakras.
  3. The Client understands that the greater proportion of these fees ( once sufficient and significant funds have been raised ) shall be given back to the poor and the needy in the form or half way houses and eco villages and other similar projects to benefit humanity.

The Client agrees that having regard to the circumstances set out in these terms and conditions, the client  will not directly or indirectly, for their own benefit or the benefit of any other Party, replicate, duplicate, the exact wordings or exact work and/or  parts of work created exclusively for Miguel enterprises unless this is expressed formally and in plain writing and confirmed by a company representative for the purposes only of creating another instance of a website for the mutual financial benefit of both parties and as agreed in writing.

 

  1. Dispute resolution

If a dispute arises out of or relates to this Agreement especially in relation to payments or any injuries occurred or similar events, a client must not commence any court or other proceedings relating to the dispute unless it has first complied with the following procedure:

  1. the client claiming that a dispute has arisen must give written notice to the other party specifying the nature of the dispute;
  2. on receipt of that notice by that other party, the parties must endeavour in good faith to resolve the dispute using informal dispute resolution techniques such as mediation, expert evaluation, arbitration or similar methods agreed by them;
  • if the parties do not agree within 14days of receipt of the notice (or such further period as the parties agree in writing) as to:
  1. the dispute resolution method and procedures to be adopted;
  2. all steps in those procedures; and
  3. the selection and compensation of the independent person required for such method,
  • the parties must mediate the dispute in accordance with the Mediation Rules of the Law Society of the Applicable State and Territory or, if the Law Society of the Applicable State or Territory does not specify rules that apply to mediation,
  • the Mediation Rules of the Law Society of Queensland.

 

  1. Warranties

 

The Client warrants and agrees that:

  1. when enrolling in this course , the Client was given reasonable time and access to read and comprehend the obligations and restraints contained in this document;
  2. the Client has had sufficient time to consider the terms of this Agreement, its implications and the advice given to them in respect of it;
  • the Client understands this Agreement and agree that its terms are fair and reasonable in the circumstances;
  1. the Client has entered into this Agreement voluntarily of their own freewill without duress, coercion, undue influence or pressure from either the Company or any other Person;
  2. The Company is relying upon these warranties in executing this Agreement.

 

 

 

  • INTELLECTUAL PROPERTY

Definitions

Intellectual Property Rights means all intellectual property rights including, without limitation: online video content , yoga poses, patents, significant copyright works, registered designs, trademarks (both registered and unregistered), reports, proposals, drawings, plans, inventions, business and trade names, tools, software, and reference material, and the right to have Confidential Information kept confidential.

Intellectual property rights and copyright ownership, applies to the online content materials, logos and designs contained and covered in the supernatural enlightenment online course website.

  • The Client agrees not to use or replicate online materials produced by the company including but not limited to websites, yoga poses and online video content;
  • The Client acknowledges that by virtue of this clause all such existing rights are vested in the Company and, on their creation, all such future rights will vest in the Company Director;
  • The Client must not use, copy or reproduce any of the intellectual property of the Company other than for the purpose of the Clients employment as approved in writing by the Employer;
  • The Client must do all things reasonably requested by the Company to enable it to assure further the rights assigned under this clause.
